PUBLIC OFFER AGREEMENT FOR THE PROVISION OF PAID EDUCATIONAL SERVICES

LLP “Foreign Educational Institution ‘Coventry Kazakhstan’”, hereinafter referred to as the “Provider”, represented by President M.M. Daulenov, acting pursuant to the Charter, hereby publishes this document as a public offer for the conclusion of a contract for the provision of paid educational services. This Offer is addressed to individuals (residents and non-residents), hereinafter referred to as the “Customer”, who wish to enroll in one of the Provider’s educational programs.
Acceptance of the terms of this Agreement shall constitute the conclusion of a contract between the Provider and the Customer in accordance with Articles 395–397 of the Civil Code of the Republic of Kazakhstan.
1. Subject of the Agreement
1.1. The Provider undertakes to render paid educational services (hereinafter – “services”) to theCustomer.
1.2. The Customer undertakes to pay for the services in the manner and under the terms set out in this Agreement.
1.3. The start and end dates of the training period, the volume and duration of the services, educational programs, and other relevant terms shall be published on the Provider’s website. Any amendments, additions, or adjustments to the duration and procedure of service provision may also be communicated by the Provider’s representatives via phone calls, messages through WhatsApp or Telegram, or via email to the contact details provided by the Customer. The Customer is solely responsible for timely review and acknowledgment of such notifications from the Provider.
1.4. This public offer agreement is an official document and is published on the website: https://coventry.edu.kz.
2. Terms of the Agreement
2.1. This document constitutes a public offer. Its publication on the Provider’s official website is deemed an offer to enter into a contract.
2.2. Acceptance of this offer shall be deemed valid upon the Customer performing any of the following actions:
- payment for the educational services;
- other actions clearly indicating the intention to receive the services.
2.3. From the moment of acceptance, this Agreement shall be considered concluded and binding upon the Parties.
2.4. Following acceptance of this offer, the Customer and the Provider agree to enter into a separate written contract on paper or using an electronic digital signature no later than the academic year start date, as published on the website or communicated by the Provider. Signing of such a written contract shall confirm the Customer’s compliance with the admission requirements for the chosen educational program.
3. Tuition and Payment Terms
3.1. The current tuition fees are published on the Provider’s official website. The fee effective at the time of acceptance shall be deemed fixed for that Customer.
3.2. Upon acceptance of this Offer, the Customer shall pay:
1. a registration fee in the amount of:
- 23 000 (twenty-three thousand) KZT – for residents of the Republic of Kazakhstan;
- 45 (forty-five) USD – for non-residents of the Republic of Kazakhstan;
2. an initial tuition fee in the amount of:
- 1,569,000 (one million five hundred sixty-nine thousand) KZT – for residents of the Republic of Kazakhstan;
- 3,000 (three thousand) USD – for non-residents of the Republic of Kazakhstan.
3.3. When making the payment, the Customer shall indicate the full name, IIN, and other identifying data of the student. If payment is made by a third party, the student’s details must also be provided.
3.4. The Customer shall submit an application to the Provider’s admissions office for enrollment in the selected educational program, accompanied by educational documents, and shall pay the registration fee. The admissions office shall review the application and documents. Upon approval, the student may proceed with the subsequent admission procedures.
3.5. Following approval, the Customer shall pay the amount specified in subparagraph 2) of Clause 3.2 of this Agreement.
3.6. The initial tuition fee and the registration fee must be paid in a lump sum and are a prerequisite for acceptance of this Offer. Payment of these fees confirms the conclusion of this Offer Agreement and acceptance of its terms.
3.7. Payments shall be made via bank transfer to the Provider’s account or through other payment instruments approved by the Provider:
- for students who are residents of the Republic of Kazakhstan, payment must be made in KZT, in accordance with the currency regulations of the Republic of Kazakhstan;
- for non-resident students, payment in foreign currency is allowed in accordance with applicable currency control regulations.
3.8. In the event of withdrawal, dismissal, or termination of the contract on other grounds, the registration and initial tuition fees are non-refundable. Refunds of other payments (in case of partial or full prepayment) shall be made in accordance with the Provider’s internal policies and regulations and the terms of any separate written agreement concluded between the Parties.
4. Rights and Obligations of the Parties
4.1. The Provider undertakes to:
- deliver the educational services in the scope and time frame consistent with the chosen program;
- provide access to educational materials, teaching staff, and infrastructure;
- inform the Customer about the learning process and any relevant changes;
- maintain the confidentiality of the Customer’s personal data.
4.2. The Customer undertakes to:
- make timely payments for the services;
- comply with the Provider’s internal rules, academic policies, and code of conduct;
- provide accurate information during registration;
- provide correct personal data for processing;
- not distribute educational materials to third parties without the Provider’s written consent.
5. Liability of the Parties
5.1. The Parties shall be liable for failure to perform or improper performance of their obligations under this Agreement in accordance with the legislation of the Republic of Kazakhstan.
5.2. The Provider shall not be liable for the inability to deliver services due to force majeure circumstances (natural disasters, military actions, regulatory restrictions, epidemics, etc.).
6. Force Majeure
6.1. The Parties shall be released from liability for failure to perform their obligations under this Agreement if such failure is caused by force majeure circumstances confirmed by the competent authorities.
6.2. The term for fulfilling obligations under this Agreement shall be extended for the duration of such force majeure.
7. Final Provisions
7.1. This public offer shall become effective from the date of its publication on the Provider’s official website and remain valid until withdrawn or replaced by a separate written agreement between the Provider and the Customer.
7.2. This Agreement shall be deemed concluded upon receipt of the tuition payment into the Provider’s bank account.
7.3. Any disputes arising under this Agreement shall be resolved through negotiations. If the Parties fail to reach agreement, the dispute shall be submitted to the courts of the Republic of Kazakhstan at the Provider’s place of registration.
7.4. The applicable law governing this Agreement shall be the law of the Republic of Kazakhstan.
7.5. Prior to the start of the academic year, the Parties shall enter into a separate written agreement. From the date of its signing, this separate agreement shall govern the relationship between the Parties, unless otherwise stipulated therein.
